Privacy and Security

This Privacy Policy describes how and when we collect, use, and share information when you make a purchase from The Avid Seamstress LTD or contact us via mobile, email or via direct messaging in Social Media. This Privacy Policy does not apply to the practices of any third parties that we do not own or control.

We respect your privacy and do not share your data with any other companies apart from your delivery address which is given to the shipping company in order to fulfil your order.

Cookies are used to store your shopping basket information and to collect anonymous information about how people use this website in order to improve the service. In order to manage traffic on the site at busy times a cookie may be used to ensure that your requests are sent to the correct server, but this data is anonymous. 

Our website is hosted by Shopify. When you visit our website Shopify collects standard internet log information. Shopify does this to find out things such as the number of visitors to this website. They collect this information in a way which does not identify anyone. Analytics information is helpful to website owners as it helps them gauge their site’s success. This is by using an analytics cookie.

Information we collect

To fulfil your order, you must provide us with certain information, such as your name, email address, postal address, payment information, and the details of your product you wish to purchase. You may also choose to provide us with additional personal information, if you contact us directly.

Why we need your information and how we use it

We rely on a number of legal bases to collect, use, and share your information, including:

  • as needed to provide our services, such as when we use your information to fulfil an order, to settle disputes, or to provide customer support;
  • when you have provided your affirmative consent, which you may revoke at any time, such as by signing up for our mailing list;
  • if necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your membership if required by tax law; and
  • as necessary for the purpose of our legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as providing and improving my services. We use your information to provide the services you requested and in our legitimate interest to improve my services.

Information Sharing and Disclosure

  • Service providers. We engage certain trusted third parties to perform functions and provide services for The Avid Seamstress, such as delivery companies (for example Royal Mail to send you your order, Yola Mail to liaise with you via email). We will share your personal information with these third parties, but only to the extent necessary to perform these services.
  • Business transfers. If we sell or merge our business, we may disclose your information as part of that transaction, only to the extent permitted by law.
  • Compliance with laws. We may collect, use, retain, and share your information if we have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others.

Data Retention

We retain your personal information only for as long as necessary to provide you with our services and as described in our Privacy Policy. However, we may also be required to retain this information to comply with our legal and regulatory obligations, to resolve disputes, and to enforce my agreements. We generally keep your data for the following time period: 5 years.

Transfers of Personal Information Outside the EU

We may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, we may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. 

Your Rights

If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. I describe these rights below:

  • Access. You may have the right to access and receive a copy of the personal information we hold about you by contacting us using the contact information below.
  • Change, restrict, delete. You may also have rights to change, restrict our use of, or delete your personal information. Absent exceptional circumstances (like where we are required to store data for legal reasons) we will generally delete your personal information upon request.
  • Object. You can object to (i) our processing of some of your information based on our legitimate interests and (ii) receiving marketing messages from me after providing your express consent to receive them. In such cases, we will delete your personal information unless we have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.
  • Complain. If you reside in the EU and wish to raise a concern about our use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.

Google Analytics

Data that is collected, processed, and stored in our Google Analytics account ("Google Analytics data") is secure and kept confidentially. Google Analytics data is used to provide and improve service, to perform system critical operations, and in rare exceptions for legal reasons as described in Google’s privacy policy.

Payment information - PayPal & Shopify Payments

All payments are processed by PayPal and Shopify Payments (we do not store any credit card details on this site).

Paypal payments - When you use your credit or debit card to purchase goods or services from an online merchant via PayPal, a sum of electronic money equivalent to the amount of the purchase you are making is issued by PayPal and credited to the merchant’s PayPal account as payment for the goods or services you are purchasing from him. Your credit or debit card is, therefore, being used for the purchase of an amount of e-money which is in turn being used as payment for the goods or services from the merchant. Your credit or debit card statement will, therefore, show PayPal as the merchant and not the merchant from whom you are purchasing the goods or services.

Our Contract

When you place an order to purchase a product from the Website, we will send you an email confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we send an email to you confirming that we have accepted the order (the ‘Order Confirmation Email’). Such acceptance will be complete at the time we send the Order Confirmation Email to you. You are seeking to enter into a contract with The Avid Seamstress when you place an order.

This contract is legally binding when you have placed an order, your order has been accepted by us and we have sent you the Confirmation Email.

The Avid Seamstress LTD will retain the title in the products until full payment has been made by you and has been received by The Avid Seamstress.

The Avid Seamstress LTD reserves the right to hold any orders prior to shipping for security review. The Avid Seamstress LTD only delivers its products to the locations listed on the Website. In the event that an order is placed for a delivery to a location where we do not deliver the order will be cancelled and a refund processed.
